The warranty period for the GENERAL MOBILE GSM Cell Phone Accessory starts from the date of delivery and lasts for two (2) years. During this warranty period, the entire product, including all its parts, is covered. If the product fails and requires repair, the time spent for repairing is added to the warranty period. If the product is replaced during the warranty period, the warranty for the replacement product is limited to the remaining warranty period of the originally purchased product.
In terms of coverage, the warranty includes any failures or defects that occur within the warranty period. The consumer has the right to request free repair or replacement of the product with a non-defective one. These rights can be exercised against the seller, manufacturer, or importer. It is important to note that the seller, manufacturer, and importer are jointly liable for fulfilling these rights.
However, if it is proven that the defect has occurred after the product has been put on the market by the manufacturer or importer, they cannot be held responsible. Additionally, if free repair or replacement would cause disproportionate difficulties for the seller, the consumer may choose to withdraw from the contract or request a price reduction in proportion to the defect.
If the consumer chooses the right to repair free of charge or to replace the product, it is mandatory for this request to be fulfilled within a maximum of thirty working days after it is communicated to the seller, manufacturer, or importer. The consumer's free repair request should be fulfilled within the maximum repair period of twenty working days. If these timelines are not met, the consumer is free to exercise other rights.
In cases where the consumer chooses to withdraw from the contract or reduce the price in proportion to the defect, the entire price paid or the amount of the discount made from the sales price should be immediately returned to the consumer. Any costs incurred due to the exercise of these rights are covered by the party responsible for fulfilling the chosen right.
If the consumer has any complaints or objections regarding the product, they can apply to the Provincial/District Consumer Arbitration Committees or Consumer Courts in their place of residence or where the consumer's transaction was made, according to the monetary value specified in the Law on the Protection of the Consumer No. 6502.
If the Warranty Certificate is not issued by the seller, the consumer may take legal actions via the General Directorate of Consumer Protection and Market Surveillance of the Ministry of Customs and Trade.
